This privacy and data policy (“Privacy Policy”) applies and has effect in respect of all of our software clients for competitive gaming, related online services (including NECC Properties and secondary competition) and other software and products made available by us (together the "Clients"), as well as any other online features relating to our business including our website at https://necc.gg/, the NECC Database, NECC Tournament Platforms (the “Websites”), any mailing lists we operate (the “Mailing List”). Together, the Clients, Website, and the Mailing List are referred to as the “Online Services”.

In the Event we require an Anti-Cheat to compete in any of the Services the following will also be collected: (“Anti-Cheat Information”)

In the event that an individual is seeking support they may be required to provide certain contact information including: (“Contact Information”)
d. Information Collected for the Purposes of Providing Analytics
We may collect technical information about your use of the Online Services through the use of tracking technologies and analytics. Personal Data we may collect includes the following: (“Analytics”)
e. Information Collected for the Purposes of Marketing Promotions and Advertising

f. Contact Information Provided when you sign up to our Mailing List
We may ask you for, or you may submit, certain contact information to us whenever you sign up to our Mailing List. This may include: (“Mailing List Information”)
g. Chat Content Created by our Users
When users submit their own User Content to any of our chat functionalities, this content may contain personal and non-personal information. This could include information in or about the User Content, such as the location of a photo or the date a file was created, or anything else a user decides to communicate using these parts of our Online Services.
h. Information Used in Order to Process Payments
When users buy services through any of our Online Services, those users submit the following information to our payment processors, Shopify, Square, and Stripe: (“Payment Information”)

When you complete any forms, respond to a survey or questionnaire, or take part in a contest or sweepstake, we collect the personal data that you provide. (“Survey Information”)

In order to appropriately rank you, we may use information available online or from publicly available sources, such as public nickname(s). (“Public Information”)
When you provide us your personal data to work with us, for example, as part of the production of an event, or to be considered for future work opportunities, we may collect the following personal data: (“Business Data”)
Personal Information is intended to be collected only for Users with Accounts; however, if any Information is provided to us in any manner by any User, this Privacy Policy will apply to such Information. All Usage Data is collected for every User of the Website and is not intended to be capable of personally identifying you, except that we may associate such Usage Data with your unique identifier in our internal systems.
a. To Provide the Online Services to You
We will use information about you (including Basic Information, Registration Information, Optional Information, Analytics and User Content, and Information Publicly Available) for delivering our Online Services to you under the Terms of Service agreed between us. The processing of information in this way is necessary for us to record the outcome of competitions you enter, your ranking and performance, and to ensure the Clients deliver the features promised and function properly, so that you have the best experience when playing, using, or developing on any one Online Services.
b. To Help Us Improve the Online Services and Fix Any Problems
We may process information about you (including Basic Information, User Content, Registration Information and Analytics) so that we can analyze and improve our Online Services.
This processing is also necessary for us to pursue our legitimate interests of:
i. Ensuring that our Online Services function properly so that you and other users have the best experience when playing any of our Clients and using the other Online Services
ii. Improving the quality of our Online Services, and providing a better experience to our users
iii. Identifying and correcting any bugs in the Clients and Online Services
We may use tools like Google Analytics, Google Bigquery, Shopify Analytics to help us understand how our Online services are used at any time.
c. To Respond to Your Enquiries and Requests for Support and to Enable you to use NECC Features
We may process Contact Information so that we are able to properly respond to your enquiries and support requests via Discord Support Tickets or NECC Support emails in accordance with the terms of use agreed between us.
d. To Acquire New Users and Engage Current Users
We may process Mailing List Information to make suggestions and recommendations to you about competitions and services that may interest you, to provide you with information about other similar services we offer, and to notify you about changes to our Clients or the services we provide.
We process this information to pursue our legitimate interests of acquiring new users for our Clients and understanding the success of our marketing efforts.
We use Mailchimp to help us send marketing communications.
We may process Basic Information, for example match replays and highlights, which are shared by our users, by publishing them on our website or social channels, to pursue our legitimate interests (and those of our community of users) of promoting gameplay and our platform, and acquiring and engaging users.
e. To Prevent Cheating, Fraud and Illegal Activity
We process personal data, including Anti-Cheat Logs for our legitimate interests of preventing cheating by players using our Client and ensuring that any use of the Online Services is lawful and non-fraudulent, does not disrupt the operation of our services, does not harass our staff or other individuals, to enforce our legal rights and to comply with our legal obligations.
Where we reasonably believe that you are cheating or may be in breach of any applicable laws or our Terms of Service, we may use your personal information to inform relevant third parties such as your law enforcement agencies about the content.
We process personal data to ensure a fair and rule-compliant platform for you, the other participants and the audience and through this ensure the integrity and credibility of our platform, tournaments, as well as esports itself as a fair competitive sport. Fair play is a vital part of our Services. As part of our efforts to maintain a fair competitive sport and fair play in esports as a whole, we may share some personal data, such as your Steam ID, with other companies of the same group, including specifically with College COD, College Halo, and other NECC Operations. This, to avoid and sanction cheating, so that fair play can be maintained. For more information, we encourage you to read our Terms and Conditions and Anti-Cheat EULA.
We reserve the right to disclose your identity to any third party who is claiming that any User Content posted by you constitutes a violation of their intellectual property rights, or of their right to privacy. You may not copy, download, or embed any User Content without the express written permission of the content owner. You may not use any User Content for any commercial purposes, or any public performances.
f. To Process Payments
We use Payment information to process payments, in accordance with the terms of a contract entered with the user.
g. To Deliver Items and Awards
We will use information about you (including Basic Information, Registration Information, Optional Information) to deliver the items that you have ordered through the NECC Store (https://necc.gg/collections/all) or prizes that you have won in our competitions.
h. To Serve Marketing, Promotions and Advertising
We will use information about you (including Basic Information, Registration Information, Optional Information and Advertising Information) to deliver more relevant ads, marketing and promotions.
We use Google Ads Manager to help us serve marketing, promotions and advertising.
i. To Conduct Research, Surveys and Contests
We will use information about you (including Registration Information, Optional Information, Basic Information and Survey Information) to conduct contests, research, surveys and sweepstakes.
j. To Potentially Conclude a Contract With You or Your Business for the Provision of Services
We will use your personal data or Business Information to properly identify you as a contractual business partner or a prospective business partner, and to contact you if there are work opportunities for you or your business.
We will store your personal data to consider you for future contracts with us, to communicate with you in order to take steps to enter into a contract with us, if we have a contract with you, to comply with our legal and contractual obligations, to optimize our planning and booking for productions and to defend and/or exercise our rights.
The legal basis for processing your personal data is performance of a contract and legitimate interests, as the case may be.
k. To Verify Your Account and Tie an Individual to an Account
In the event of account errors, login errors or anything tied to payment information we will use any related information to verify the information and rectify whatever problem in the specific process. Information may be obtained from you through the use of cookies if you opt into the use of cookies when that option is made available to you. Cookies are files with a small amount of data which may include an anonymous unique identifier. We may make cookies available to give you the best online experience possible. The cookies we use do not contain personally identifiable information; however, once you choose to enter our site with personally identifiable information that information may be linked to the data stored in the cookie.
We will share your information with third parties only in the ways that are described in this Privacy Policy. Third parties mentioned in this Privacy Policy: We will disclose personal data to any of the third parties mentioned in this Privacy Policy, for the purposes set out in this Privacy Policy.
Group members, personnel, suppliers or subcontractors: We keep your information confidential, but may disclose it to any member of our group (which means our subsidiaries, affiliates, sister companies and our ultimate holding company and its subsidiaries and affiliates, as defined in section 1159 of the Companies Act 2006), our personnel, suppliers or subcontractors insofar as it is reasonably necessary for the purposes set out in this Privacy Policy. However, this is on the basis that they have agreed to safeguard the personal information.

Enforcement: We may also disclose your personal information to third parties in order to enforce or apply the terms of agreements, to investigate potential breaches, or to protect the rights, property or safety of the NECC, our customers, or others
API: Your information may be shared for a short period of time with third parties through an application programming interface (an API), which we may use when you create your Account to help us verify who you are. We will instruct any such third party not to retain any of your Personal Information in their system; however, they may keep a record of the numbers of their users who created an Account with LeagueOS or the NECC and accessed the relevant API.
You acknowledge that Sponsors will have access to de-identified and aggregated data about Users and certain competitions to verify engagement and make a determination about sponsoring such competition. The NECC may also have access to certain data about you that you provide when joining a League, or that constitutes aggregated data about your historical participation and performance.
We may share your Information with credit card issuers and financial institutions in order to obtain payment from you, such that they may process payments and refunds, verify the absence of fraud, or assist in debt collection, in the course of the performance of a contract or on the basis of other legitimate interests.
If you do not wish to receive promotional or other marketing material from us or third parties then you can opt-out by clicking unsubscribe in any of our communications, changing your account settings in the Online Services at any time. Alternatively, you can contact us via support@neccathletics.com and let us know that you no longer wish to receive promotional or other marketing material from us and / or third parties.
This policy applies to every User, including children under 13 when we have received the consent of a parent or other legal guardian. We do not use our Online Services to knowingly solicit information from or market to children under the age of 13. We do not knowingly collect Information from children under 13 unless we have the consent of the parent or other legal guardian of such a child. If you become aware that a child under 13 has provided us with Personal Information without such consent, please contact us. If we become aware that a child under 13 has provided us with Personal Information without such consent, we will take steps to terminate the child’s Account and delete any Personal Information provided to us. We will not require a child to disclose more information than is reasonably necessary to participate in the Services. If you are a parent or other legal guardian who has provided consent for a child under 13 to use the Website and Services, you have the right to review your child’s collected Personal Information, request deletion of the same, and at any time refuse to allow any further collection or use of your child’s information.

a. Ask for a Copy of Data We Are Processing About You and Have Inaccuracies Corrected
You have the right to request a copy of the personal information we hold about you and to have any inaccuracies corrected.
We will use reasonable efforts to the extent required by law to supply, correct or delete personal information held about you on our files (and with any third parties to whom it has been disclosed to).
b. Object to us processing data about you
You can ask us to restrict, stop processing, or to delete your personal data if:
i. You consented to our processing the personal data, and have withdrawn that consent thus stopping your engagement with the NECC or it’s properties
ii. We no longer need to process that personal data for the reason it was collected
iii. We are processing that personal data because it is in the public interest or it is in order to pursue a legitimate interest of the NECC or a third party, you don’t agree with that processing, and there is no overriding legitimate interest for us to continue processing it
iv. The personal data was unlawfully processed
v. You need the personal data to be deleted in order to comply with legal obligations
vi. The personal data is processed in relation to the offer of a service to a child
c. Obtain a machine readable copy of your personal data, which you can use with another service provider
If we are processing data in order to perform our obligations to you, or because you consented, or if that processing is carried out by automated means, we will help you to move, copy or transfer your personal data to other IT systems.
If you request, we will supply you with the relevant personal data in a commonly used, machine-readable and interoperable format. Where it is technically feasible, you can ask us to send this information directly to another IT system provider if you prefer.
d. Make a complaint to a Supervisory Authority

If you do not agree with the way we have processed your data or responded to your concerns, an alternative is to submit a complaint to a Data Protection Supervisory Authority.

User Content and Forum Information are retained indefinitely. If you would like us to delete your Forum account or any User Content that you have posted, please contact us via support@neccathletics.com.
We will take all reasonable technical and organizational precautions to prevent the loss, misuse or alteration of your personal information. For example, our databases are password protected and limited to essential employees only. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
Depending on the state or country in which you reside, or in which you access the Website, you may be entitled to certain notices, or there may be additional restrictions or disclosures required regarding the use of your Information. The jurisdiction-specific information provided shall be considered an addendum to and incorporated into this Privacy Policy to the extent such information applies to you.
It is possible that your personal information may be transferred outside of the NECC’s operating territories by third parties referred to in the policies as being the recipients of your data, and specifically your personal information may be transferred to other companies that belong to the same company group as the NECC. We recommend that you refer to the privacy policies and/or terms and conditions of these third parties if you are concerned about your data being transferred outside a region in which you reside.
When we transfer your information outside of the originating region, we have agreements in place with those parties which include standard data protection clauses adopted by a data protection regulator and approved by an equivalent to the European Commission to ensure that appropriate safeguards are in place to protect your personal data.
You acknowledge that when you choose to participate in any public aspect of the NECC Operating Services, including participation in a public League, or participating in any live streaming activity related to your Service whether through NECC, it’s Subsidiaries, or an affiliated third party, there may be inherent risks in doing so related to your data privacy.
You acknowledge that your decision to use these public aspects of NECC Services or other Operating Services which are accessible through or linked from the NECC, and to upload or transmit any User Content through the same, is your sole decision, and we cannot guarantee that any unauthorized copying, use, or distribution by other Users or third parties will not take place. To the extent that you reveal any personally-identifiable information in the course of uploading or streaming User Content in any manner, you do so at your own risk, and LeagueOS is not and cannot be responsible for the use by third parties of such information you reveal.
YOU ACKNOWLEDGE THAT NECC’S RESPONSIBILITIES TO YOU REGARDING THE COLLECTION, USE, DISCLOSURE, AND PROTECTION OF YOUR DATA DO NOT EXTEND TO DATA WHICH NECC DOES NOT CONTROL, OR WHICH YOU DETERMINE TO DISCLOSE OR PROVIDE DIRECTLY TO ANOTHER USER OR THIRD PARTY. YOU HEREBY AGREE THAT THE NECC SHALL NOT BE LIABLE FOR ANY UNAUTHORIZED COPYING, USE, OR DISTRIBUTION YOUR CONTENT BY THIRD PARTIES, AND RELEASE AND FOREVER WAIVE ANY CLAIMS YOU MAY HAVE AGAINST US FOR ANY SUCH UNAUTHORIZED USE UNDER ANY THEORY.
